In a May 2012 post, the Wall Street Journal actually asked “Does Facebook Wreck Marriages?”
The article quoted a British legal services firm that claimed more than a third of UK divorce filings contained the word Facebook. Likewise cited was the statistic that 80% of US divorce attorneys claim they’ve seen a rise in the number of cases involving social networking.
Although there are no Rhode Island divorce statistics current on the issue, the same evidentiary issues exist in Rhode Island that confront Courts worldwide. Rhode Island Courts can consider patterns of behavior demonstrating parenting skills–or lack thereof–excessive alcohol or drug consumption boasted about online, or even disparaging comments posted by a Rhode Island litigant.
Other jurisdictions have even Ordered Facebook passwords to be provided in discovery.
